Lord of the Rings

The  “The Lord of the Rings “trilogies were filmed simultaneously in New Zealand in 1999-2000, they are   a magnificent piece of  fiction which extended right through  to the  end title.

The first movie falsely and without any  rights  used the American Humane Association ( AHA) end title   to the effect that no animals were hurt  when the reality was that there was wide spread concern of animal welfare  issues  on the set.

Those who raised their concerns  were silenced .

On 15 November 2001 The American Humane society wrote to Neil Wells, Barrister Trustee of Animal welfare Institute of New Zealand ( AWINZ) and raised their concerns.

Correspondence obtained from  Ministry of  agriculture set out  more background  and concerns  .

These documents have not been available to the public , I obtained them by way of OIA  ( official information  act ) request share them in the  spirit of transparency  ..

WHO IS AWINZ

According to  its trust deed, the trustees of AWINZ at the time  it was involved in the   movie  were

Sarah Giltrap wife of Richard Giltrap ( director  of Giltrap Toyota etc ) residential  address 18 Bella Vista Road, Herne Bay,

Neil Edward Wells Barrister  1156 Huia Rd Huia Auckland 09-811 8722, now manager of Animal welfare  Waitakere

We know for a certainty that all four were still trustees in 2006  because when I contacted Nuala Grove and Sarah Giltrap and asked them if they were still trustees of AWINZ they promptly resigned and   my simple question     became an  accusation of  the Harassment  that they had suffered at my hand  which forced them into  resigning  ( this accusation was made in an affidavit by Neil Wells  the Baptist Elder.)

All these people as trustees had a responsibility to the truth but they allowed  a falsehood to be published  to the world in the end title. If it was a true trust  then  the accreditation would have been discussed  by all.

We have to ask how can as AWINZ have monitored a Movie  and claim that they did  not know of the injuries to the animals  when the  trust comprised only of  four people  – unless it was a sham trust..  but then I said it was  a sham trust and  was sued for saying that   so having been sued  for saying it was a  sham trust  it must be a real trust  in which case all the  trustees are  responsible for  the actions of the trust – they  can’t  have it both ways .

I have now been threatened with further legal action   just for mentioning the names of the trustees.  I have reason to believe  that Mrs Grove  was married to a judge  and  now her son is there  to ensure than any  thing his mother was involved in stays firmly under wraps.

We all have to take responsibility for our lives  except when your son is a barrister, your actions can simply be  sued away.. that is New Zealand today .

How  can Nuala Grove and Sarah Giltrap  claim that they were ignorant of the  suffering , for profit , of the very animals which they claim  to have   formed their   “Humanitarian ” trust for.

How can they  now claim that  they were ignorant of  the issues  surrounding what was going on with regards to the legal action  by AWINZ against me , they have  all  been made  aware of the facts and I have asked each and every one to speak the truth rather  than stand by and consent in silence to  the systematic beating up I have received  for  questioning the  existence of AWINZ.

Only when the spot light  goes on them   do they come  out and threaten to sue  to put the lid back on . Humanitarians  resolve the issues with discussion     open ness and truth.

I made that invertatoin to the  barristers  representing AWINZ  lets  meet lets talk .. but no they chose to sue and use legal manipulation to deny me  my rights to a fair hearing and presenting  the truth.

Trustees duties

Trustees have a legal responsibility to the objectives and purpose of the trust; in this case  the purpose was set out clearly in the trust deed at point 4  and includes

(a To prevent ill treatment to and the relief of suffering of animals;

(b) To provide animal welfare services;

(c) To encourage and develop by humane education individual responsibility for the welfare of animals and the promotion of humane attitudes in society to animals and people;

(e) To support and encourage the study of animal welfare issues;

I now know that these people were specifically recruited for the trust and what is even more I found

A further invoice for the setting up  of AWINZ was found in the archives of Waitakere city council along  with very interesting documents  which together those I obtained from MAF  prove that AWINZ was publicly funded  for private gain.

IF these people are the Humanitarians they claim they are  would they not   at some point have said “what is happening to you  at the hands of AWINZ is not  right  I can help put a stop to this.”

It is akin to watching   some one be beaten up  and  continue to walk by and do nothing,  The very least I would expect an honourable person  to do   would be to speak up .

Graeme John  Coutts , Sarah Giltrap  ( nee Amos ) Nuala  Grove all had the ability to  speak out .

Sarah and Nuala pulled out their lawyers  . Nuala’s  son  barrister Daniel William Grove, asked me  to  not to  contact either  again.

Graeme Coutts on the other hand  teamed up with Wells and  Wyn Hoadley  to sue me in an attempt to  silence me.  This has led to  Three years of litigation   which has come  at a  huge personal and  financial cost to me .

I continue to speak up and the actions against me  make me more determined to expose all those involved  and the roles they played.

Tomorrow  the political  connection .

This  is a  copy of a letter sent to Mrs Grove after a telephone conversation in which she asked me to put my request in writing   following this letter I received  a reply from her son not to contact her again.

I am in possession of a trust deed   for the Animal Welfare Institute of New Zealand  which  bears your name.

I raised questions of concern with regards to this trust and its lack of public accountability in the role it plays in animal welfare.

For  questioning I was  sued  by three people purporting to be trustees of the trust.

I have been to Wellington   and examined the   MAF files  and I cannot find  any  documents there which relate to   any of the trustees  consenting to the  trust becoming an approved organisation .

I have been told that you resigned from the trust

Could you please advise

1. How you became a trustee
2. When  this occurred
3. when did you sign the trust deed
4. Did you go to trust meetings? if so how many
5. what your involvement was in the trust
6. What was your understanding   of what the trust did?
7. When did you resign
8. Why did you resign.

I would prefer this in an affidavit  if I could  for court Wednesday morning 10 am High court.

The trust  is involved in  a matter of public concern  and  through questioning what I saw as corruption  has now  cost me far more than any criminal would be  subjected to .

I hope that as one person  to another   you could show compassion and support me in providing  answers to  the above.  Thank you

The situation as I see it

Your mother and Sarah  were trustees of AWINZ.  I suspected that the trust was a sham. I called it a sham   and was sued.

It was not   Wells who sued me it was  the trustees of AWINZ . or at least  those claiming to be AWINZ

Your mother and  Sarah   lent their names to a trust ( AWINZ)    which  has law enforcement  abilities  and  public responsibilities, they cannot claim to be ignorant of the  significance of AWINZ.   It must have been discussed  what the trust was and how it was  applying for approved status   under  section 122 Criteria of the animal welfare act.

You of all people  should know  of the legal responsibilities of trustees and I hope that   your mum and Sarah  were aware of their responsibilities to  legislation  especially if the trust had legislative powers and responsibilities  to law enforcement.

I will be more than happy  to  amend  the page if the evidence I requested is provided,  other wise in absence of that evidence  the  public documents I have  show that  Sarah and your mother  were  two of four trustees  of an organisation which monitored the  animal action of the lord of  the rings and applied to the minister  for  approved status.

As trustees  they must have  met and discussed the actions of the trust ,the way the animal welfare officers were employed and the  discussion about  providing the accreditation, the  discussions with regards to the  animal welfare officers under their control  the accountability to the government .

Of course  if they were not involved in that way then the only other possibility which  exists is that Neil Wells acted on his own in which case   the trust was a sham trust and I  was wrong fully sued. If your Mother and Sarah are happy to  let that be  then they should remain silent. But then that would  conflict with  what a Humanitarian person would be expected to do.

I have  lost $200,000  my marriage and half my family because of AWINZ  and you complain that the people  who hold the truth  wish to   conceal it  from the world.

If  Sarah and your mum would  like to  do the decent thing  then they would make me very happy.  I have  had enough of AWINZ    but I will not give up until it is totally exposed.

I am not unreasonable  I worship GOOD , I support transparency and   truth   I hope that your Mother and Sarah  can too.

Neither my mother nor Sarah Giltrap have anything to do with your dispute with Mr Wells. They do not know what it is about and do not want anything to do with it.

I fail to see why you are involving them in this matter.  They have no interest in getting involved in litigation, however, if defamatory comments are published by you, an appropriate application will be made to the Court.

I believe that it is  important to  identify those  involved  with AWINZ . The  details I provided on the blog were obtained  from public sources and  there fore are not in breach of privacy .

People need to be accountable to the truth .  If they do not wish to be found  they should stay out of the phone book  and  off other public records.

Your clients are aware of the circumstances      and   chose to stand by while  I was under attack from those  who  sued me in the name of AWINZ, the trust  which  they are shown to be trustees of(  and  there is  no record of them having resigned from .)

If you could please supply me   with evidence that they were not members of AWINZ at that time and had resigned   and

If you  could please point out   that which you consider to be defamatory   I will happily amend  the blog

For the record  I   had spoken to your mother about her signature on the trust deed , I asked your mother a simple question as to when she had signed the trust deed   she told me  that all she could say was that it was her signature.

I was wanting to find out if the deed  was signed in 2000 or some  later time and retrospectively dated.

Her truth  will make a lot of difference to many people , what has she  got to hide?
